TERMS AND CONDITIONS- Apartment Rental Agreement
These Terms and Conditions govern the rental of apartments at Aura Apartments, located at 23 Lý Nhật Quang, Sơn Trà, Đà Nẵng. By confirming a reservation, signing a lease, or making payment, the Guest/Tenant agrees to comply with the following terms:
1. BOOKING AND PAYMENT
1.1 A reservation is confirmed only after receipt of the required deposit or full payment.
1.2 Monthly rental payments must be made on or before the due date stated in the lease agreement.
1.3 Late payments may be subject to penalties or service suspension as outlined in the lease.
2. SECURITY DEPOSIT
2.1 A security deposit is required prior to check-in.
2.2 The deposit will be refunded within the agreed timeframe after check-out, subject to:
* No outstanding payments
* No damages beyond normal wear and tear
* No violation of house rules
2.3 Any repair, replacement, cleaning, or unpaid utility costs will be deducted from the deposit.
3. CHECK-IN AND CHECK-OUT
3.1 Check-in and check-out times must follow the agreed schedule.
3.2 Early check-in or late check-out is subject to availability and may incur additional charges.
3.3 Keys, access cards, and parking cards must be returned upon check-out. Loss may result in replacement fees.
4. USE OF PREMISES
4.1 The apartment shall be used for residential purposes only.
4.2 Subletting or transferring the apartment to third parties without written approval is strictly prohibited.
4.3 The number of occupants must not exceed the agreed limit.
5. HOUSE RULES
Guests/Tenants must comply with all building regulations, including but not limited to:
* No pets allowed (unless explicitly permitted in writing).
* No illegal activities.
* No excessive noise, especially during quiet hours.
* Proper disposal of trash.
* No smoking in prohibited areas.
* Respect for common areas and other residents.
Violation may result in warnings, penalties, or termination of the rental agreement without refund.
6. UTILITIES AND SERVICES
6.1 Utility charges (electricity, water, internet, parking, etc.) shall be paid according to the agreement.
6.2 Management reserves the right to temporarily interrupt services due to maintenance, repairs, or force majeure events.
7. MAINTENANCE AND DAMAGES
7.1 Guests/Tenants must maintain the apartment in good condition.
7.2 Any damage must be reported immediately.
7.3 The Tenant is responsible for damages caused by negligence, misuse, or intentional acts.
8. LIABILITY
8.1 Aura Apartments is not responsible for loss, theft, or damage to personal belongings.
8.2 Guests/Tenants are advised to secure valuables properly.
8.3 Management shall not be liable for events beyond reasonable control (natural disasters, government actions, power outages, etc.).
9. TERMINATION
9.1 Either party may terminate the agreement according to the notice period specified in the lease.
9.2 Early termination may result in forfeiture of deposit or penalties as agreed.
10. FORCE MAJEURE
Management shall not be held liable for failure to perform obligations due to circumstances beyond its control, including but not limited to natural disasters, fire, government restrictions, or emergencies.
11. GOVERNING LAW
This agreement shall be governed and interpreted in accordance with the laws of the Socialist Republic of Vietnam.
By proceeding with payment or occupying the apartment, the Guest/Tenant acknowledges that they have read, understood, and agreed to these Terms and Conditions.
